What the current New York rules actually say.

Kratom is legal in New York State with a 21+ age restriction under S4552A/A2340A, plus consumer warning label requirements under S8285/A5852A. Nassau County passed a full ban March 9, 2026 (first NY county-level ban). Washington County has since followed and now prohibits kratom sales and distribution county-wide. Oneida County now has an active ban: the county Health Department issued a public health order prohibiting the sale of kratom and kratom-derived products county-wide, effective June 5, 2026, and on June 30, 2026 County Executive Anthony Picente introduced a local law to codify it (subject to a 30-day Board of Legislators review and a public hearing, then submission to the NY Secretary of State). Suffolk County I.R. 1279-2026 remains pending and has not been signed. After the April 21, 2026 hearing was recessed amid 50+ speakers, the resolution was amended June 18, 2026 and given a further public hearing June 23, 2026, then returned to committee for review ahead of a possible full-legislature vote at a later meeting. The Suffolk measure targets synthetic 7-hydroxymitragynine products sold in gas stations and smoke shops and exempts drinks steeped from natural kratom leaf.

Local exceptions: Banned in Nassau County and Washington County. Oneida County prohibits the sale of kratom county-wide under a Health Department public health order effective June 5, 2026 (local law to codify it introduced June 30, 2026, now in 30-day review). Suffolk County ban (I.R. 1279-2026) is still pending and unsigned as of July 13, 2026 (amended June 18, further hearing June 23, returned to committee); it would target synthetic 7-OH products and exempt natural-leaf drinks. Statewide 21+ age restriction and warning-label rules apply elsewhere.
