Kratom is currently legal in Delaware, and the legislature has chosen regulation over prohibition. HS 1 for HB 332, the Delaware Kratom Consumer Protection Act sponsored by Rep. Melanie Ross Levin, passed the House 39-1 and the Senate 19-0 in the final hours of the session that closed July 1, 2026, and is now law, as Delaware Public Media reported on September 10, 2026; the signing and effective dates have not been confirmed. As passed, it sets a minimum sales age of 21, imposes labeling and disclosure requirements, restricts how kratom products are prepared, distributed, sold, and advertised, imposes civil penalties, and directs the Division of Alcohol and Tobacco Enforcement to report on kratom-related adverse events by December 31, 2026. The September report adds that state agencies are to report on kratom testing and retailer licensing by January 2027. Sen. Kyra Hoffner's competing ban bill never advanced and died when the 153rd General Assembly adjourned.
