Companion bill SB 48 targets 7-OH and synthetic byproducts with a 0.4% allowable threshold. The framework was challenged in federal court and survived. Botanic Tonics LLC and the Global Kratom Coalition sought a preliminary injunction against the Kratom Regulation Act; on May 4, 2026, U.S. District Judge Howard C. Nielson Jr. denied it, holding that states retain the power to ban specific products within their borders and rejecting the argument that federal food and drug law preempts the Act. The plaintiffs filed an interlocutory appeal with the Tenth Circuit on May 5, 2026, the Act took effect on May 6, 2026, and no appellate decision on the merits has issued. The law is in force in the meantime: only pure leaf may be sold, only through registered retailers, and only to purchasers 21 and older.
