01Acceptance and use of site

The following terms and conditions apply to the sale of products by Hudson Valley Botanicals LLC ("The Seller," "we," "us," "our") to the purchaser of those products ("The Buyer," "you"). By accessing or using hudsonvalleybotanicals.com ("the site") and any of the products or services offered, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the site.

The Seller reserves the right to alter these terms at any time. The Buyer agrees to all of the terms and conditions applied to them by The Seller, including any updates posted on this page.

We grant you a limited, non-exclusive, revocable license to access and use the site for lawful personal and consumer purposes. You may not use the site to:

• Violate any applicable federal, state, or local law.
• Scrape, copy, or harvest content without written permission.
• Reverse-engineer, disassemble, or interfere with site infrastructure.
• Misrepresent your identity, age, or location.
• Upload malicious code, attempt to gain unauthorized access, or disrupt other users.

We reserve the right to suspend or terminate access at any time if we reasonably believe these terms have been violated.

02Account registration

You do not have to create an account to browse, but you do need one to place an order. When you register:

• You must provide accurate, current information and keep it up to date.
• You are responsible for keeping your password secure and for all activity on your account.
• You must notify us through the contact page if you suspect unauthorized access.
• You must meet the minimum purchase age for your state (see Disclaimers below).

We may decline, suspend, or close any account at our discretion, including for suspected fraud, repeated chargebacks, or ongoing violation of these terms.

03Products and availability

The Buyer recognizes that the products offered by The Seller have not been approved for use by the Food and Drug Administration, and as such are not intended to diagnose, treat, cure, or prevent any disease.

Our products are not dietary supplements but a precise amount of a pure ingredient, sold as a raw material. We attest exclusively to the quality, purity, and description of the ingredients we provide. Our products are for use and handling only by persons with the knowledge and equipment to safely handle these ingredients.

Availability and accuracy

We make a genuine effort to describe our products accurately, including strain, weight, origin, lab test results, and price. Even so:

• Product photos are representative. Actual packaging may vary slightly between batches.
• Availability of specific strains or batches is not guaranteed. We may run out of a given lot while a new one is being tested.
• Certain products may be restricted or unavailable for shipment to certain states or localities based on applicable law. We maintain a current list of restricted jurisdictions and do not ship kratom to areas where its sale is prohibited.
• We reserve the right to limit order quantities, refuse service, or cancel orders at our discretion.

If we discover a pricing or description error after you have placed an order, we will contact you before shipment and give you the choice to continue at the corrected terms or cancel.

04Ordering and pricing

When you place an order, you are making an offer to buy the products in your cart at the price listed. Your order is accepted when we send an order confirmation email; until that point, we reserve the right to decline any order.

Prices and currency

• All prices are listed in US dollars (USD).
• Prices may change at any time. The price in effect at the moment you check out is the price that applies.
• Sales tax, if any, is calculated and displayed at checkout based on your shipping destination.

Order confirmations

You'll receive an email order confirmation once your order is accepted. A second email with tracking information is sent when the order ships. If you don't see these emails in your inbox, check your spam folder and verify your email address on file.

05Shipping and returns

Shipping

• We offer free standard shipping on US orders over $75.
• Orders placed before 11:00 AM Eastern on a business day typically ship the same day. Same-day shipment is not guaranteed.
• We do not ship to states, counties, or municipalities where the sale of kratom is prohibited. Orders placed for restricted areas will be canceled and refunded.

USPS shipping times

• USPS Priority Mail: typically 2 to 3 business days.
• USPS Priority Mail Express: typically 1 to 2 business days.

UPS shipping times

• UPS Ground Advantage: typically 2 to 5 business days, depending on distance.
• UPS Ground: typically 1 to 5 business days, depending on distance.
• UPS 3 Day Select: 3 business days.
• UPS 2nd Day Air: 2 business days.
• UPS Next Day Air: 1 business day.

The transit time for a package from The Seller's origin to The Buyer's destination is not guaranteed. Delivery times are estimates provided by the carriers and may vary based on location, weather, and other factors beyond our control.

The Seller cannot be held responsible for late or lost packages caused by USPS or UPS. Express packages that do not arrive within the carrier's guaranteed timeframe will receive a shipping refund upon request, subject to carrier confirmation of the delay.

If a shipment is returned to us due to The Buyer's fault (incorrect address, refusal of shipment, or nonpayment), we will refund the order amount minus the shipping cost (even if The Buyer was originally eligible for free shipping).

Returns

If you are not completely satisfied with your unopened purchase, you can request a store credit within 30 days of delivery by following these steps:

• The product must be in its original, sealed, unopened packaging.
• Submit your return request through the contact page with: your order number, the product name, your reason for return, and photos showing the sealed/unopened product and packaging.

Return terms

• Return requests must be submitted within 30 days of delivery.
• A store credit equal to the purchase price will be issued after we receive and inspect the unopened product. Credit is valid toward future purchases for 12 months.
• Return shipping is paid by the customer.
• For safety and quality assurance, we cannot accept returns of opened or used products.
• Items damaged during return shipping are not eligible for credit. Please package your return carefully.
• We are not responsible for items damaged or lost during return transit.
• Products must have been purchased directly from this site to be eligible for return.
• If the original payment was made by credit card, a $1.50 refund processing fee applies and is deducted from the credit issued.
• We reserve the right to deny return requests that do not meet these criteria.

Damaged or incorrect items: contact us within 7 days of delivery with a photo and we will make it right, usually by reshipment.

These return terms are subject to change.

06Payments

We accept the payment methods displayed at checkout. All prices are listed in US dollars. Payment must be received in full before orders are processed and shipped. The Seller reserves the right to change prices at any time and to correct pricing errors that may inadvertently occur. Sales tax, where applicable, is calculated and displayed at checkout.

Payment processing is handled by Waave, a PCI-DSS compliant third party. We never see or store full card numbers, expiration dates, or CVV codes on our own servers.

• By providing payment information, you represent that you are authorized to use the payment method and that the charge will be honored.
• If a payment is declined, reversed, or charged back, we reserve the right to cancel the related order and recover reasonable costs.
• If you believe a charge was made in error, reach us through the contact page before initiating a chargeback. We can almost always resolve an issue directly and faster than a bank dispute.

07Intellectual property

All content on the site, including text, graphics, logos, icons, images, product photography, videos, software, and the Garuda and Hudson Valley Botanicals names and marks, is the property of Hudson Valley Botanicals or its licensors and is protected by US and international intellectual property laws.

You may not copy, reproduce, distribute, publish, transmit, modify, or create derivative works from any site content without our prior written permission. Limited personal use, such as saving a product page for your own reference, is fine. Commercial reuse, scraping, and republishing are not.

08User content and conduct

When you submit content to the site, including product reviews, comments, support messages, or social posts tagging us, you grant Hudson Valley Botanicals a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with our business.

You agree not to submit content that:

• Is false, misleading, defamatory, or infringes any third party's rights.
• Contains personal information of other people without their consent.
• Makes health, medical, or disease-treatment claims about our products.
• Is abusive, threatening, or harassing toward other customers or us.
• Contains spam, commercial solicitations, or links to unrelated products.

We reserve the right to edit or remove user content that violates these rules.

10Limitation of liability

In no event shall The Seller be liable for any use by The Buyer of the products, or any loss, claim, injury, damage, or liability of whatever kind or nature, which may arise from or in connection with this Agreement or the use, handling, or storage of the products.

To the maximum extent permitted by law, Hudson Valley Botanicals LLC, its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or your purchase of products, including but not limited to loss of profits, loss of data, or personal injury, even if we have been advised of the possibility of such damages.

The Buyer agrees to indemnify, defend, and hold harmless The Seller, its officers, agents, and employees from any liability, loss, or damage they may suffer as a result of claims, demands, costs, or judgments against them arising out of the use or disposition of the products by The Buyer, except to the extent resulting from the gross negligence or willful misconduct of The Seller.

The Seller's maximum aggregate liability arising out of or in connection with any order, whether in contract, tort, or otherwise, shall be limited to the purchase amount paid by The Buyer for the product in question.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11Governing law and disputes

These Terms & Conditions are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising under or relating to these terms or your use of the site will be resolved exclusively in the state or federal courts located in New York, and you consent to personal jurisdiction in those courts.

Before filing any formal dispute, please contact us in writing so we can try to resolve the issue directly. Most disputes can be settled quickly by email. If we can't reach a resolution, either party may proceed under the terms of this section.

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.
