Full legal detail
Kratom is legal at the state level in Mississippi, with KCPA-style age restrictions (21+) and a statewide ban on synthetic kratom extracts and high-concentration 7-OH under HB 1077 (effective July 1, 2025). However, widespread local bans affect large portions of the state. More than 30 Mississippi cities and counties ban kratom, including Tupelo (banned February 3, 2026), the City of Union (banned May 5, 2026), and Magee (banned July 2026). Tupelo enforcement was held for seven months while a retailer challenge ran in Lee County Circuit Court; after that suit was dismissed in August 2026, the police department gave retailers 48 hours notice and began enforcing at 10:00 a.m. on September 12, 2026, covering use, sale, distribution, and public display, with product found after enactment confiscated. Lee County, which surrounds Tupelo, revived its own ordinance covering the possession, sale and distribution of kratom after Circuit Judge John White dismissed a retailer's appeal as abandoned, and began enforcing it on September 18, 2026; violations are a misdemeanor with a fine of up to $1,000 and up to six months in jail. Not every local ban has stuck: Jones County rescinded its ban in May 2025, choosing to rely on the statewide regulation instead.
