A competing total ban was defeated in the House by one vote. Sales have not resumed: licensing rules have to be written first.

North Dakota now regulates natural kratom by statute and bans synthetic kratom products. The August 2026 executive-order prohibition has been superseded. On August 3, 2026, Governor Kelly Armstrong and Attorney General Drew Wrigley announced executive actions banning kratom statewide: the Governor declared a public health emergency and prohibited the sale, use, and possession of all kratom and kratom products effective 5 p.m. on August 5, 2026, and the North Dakota Board of Pharmacy issued an emergency rule classifying 7-hydroxymitragynine (7-OH) as a Schedule 1 controlled substance for 180 days. The Governor then called a special legislative session, which opened September 2, 2026. On the morning of September 4, 2026 the Legislature passed House Bill 1628 and the Governor signed it that afternoon. HB 1628 bans the sale, possession, and use of synthetic kratom products, and regulates natural kratom rather than prohibiting it: purchasers must be 21 or older, labeling must be accurate, and sales require a licensed seller. The competing measure, Senate Bill 2408, would have banned natural leaf outright; it passed the Senate 46 to 1 and was defeated in the House 47 to 46. Natural leaf therefore has a statutory path back to a 21 and over market, but it is not on sale yet: state officials say kratom remains unavailable until licensing rules are written and implemented, and the Legislature's administrative rules committee does not meet until December 2026. The earlier status quo, under which kratom was unregulated while an interim Legislative Management study under HB 1566 (signed April 28, 2025) was underway, is over.

Natural kratom is legal for buyers 21 and over under HB 1628, signed September 4, 2026, with labeling and licensed-seller requirements; synthetic kratom products are banned.
