Kratom is legal in North Dakota. The 2025 KCPA push was converted into an interim Legislative Management study under HB 1566 (signed April 28, 2025) rather than immediate regulation. The study covers production, manufacturing, distribution, and retail sale, with a report and proposed legislation due to the 70th Legislative Assembly. A prior ban attempt (HB 1101) failed in early 2025.
