Separately, the North Dakota Board of Pharmacy issued an emergency rule, signed by the Governor, classifying 7-hydroxymitragynine (7-OH) as a Schedule 1 controlled substance for 180 days. The Governor has called a special legislative session for September 2, 2026 to codify the prohibition in state law and address enforcement authority. This replaces the prior status quo, under which kratom was unregulated while an interim Legislative Management study under HB 1566 (signed April 28, 2025) was underway.
