The Schoharie County Board of Supervisors adopted Local Law No. 6 of 2026, the "Local Law Imposing a Prohibition on the Sale, Marketing and Purchase of Kratom and Derivatives Thereof in Schoharie County," on October 16, 2026. The Clerk of the Board certified it that day on the county's filing form for the New York Department of State as a final adoption by the Board alone. Section 10 makes the law effective on filing with the Secretary of State.

Section 6 makes it unlawful to distribute, offer for sale, sell, market or advertise for sale kratom or its derivatives in Schoharie County. Section 5 defines kratom as the plant Mitragyna speciosa and all its parts, ingredients and derivatives, synthetics included, so natural leaf sits inside the ban. The only exemption is FDA-approved kratom, or kratom dispensed by a licensed pharmacist on a prescription.

The county Public Health Department, the Sheriff's Department, the State Police and federal agencies may enforce it, including inspections of sellers and the vehicles they use, and kratom found is confiscated. Penalties run up to $500 per item confiscated or advertisement for a first violation and up to $1,000 per item or advertisement for each later one, and a willful violation may be prosecuted under Public Health Law section 12-b.

Hudson Valley Botanicals stopped shipping to Schoharie County addresses on October 19, 2026.
