Dutchess County, NYSigned, Not Yet In Effect

Dutchess County landed on regulation rather than prohibition. County Executive Sue Serino announced a countywide kratom ban on July 30, 2026, but the County Legislature did not take that version up. It wrote its own narrower measure, Resolution 2026136, and adopted that unanimously on August 10, 2026. County Executive Serino then signed it as Dutchess County Local Law No. 6 of 2026, "Prohibiting the Sale and Distribution of Concentrated and Synthetic 7-Hydroxymitragynine (7-OH) Kratom Products in Dutchess County"; her memo to legislators is dated September 10, and the Legislature posted its Notice of Adoption on September 14. She said she signed because "any step forward is better than maintaining the status quo," said the law "does not go far enough," and said she will explore "returning to the Legislature for further action in the coming months." It restricts products containing 7-hydroxymitragynine above 2 percent of total alkaloids or more than 1 milligram per serving, the same thresholds the state bill uses, and leaves plain leaf kratom alone. It also bans MGM-15, MGM-16, mitragynine pseudoindoxyl and their structural analogs, reaches online and out-of-county sellers who ship to Dutchess addresses, and carries civil penalties of up to $1,500 for a first violation and up to $3,000 for repeats, plus up to $500 for a sale to someone under 21. It exempts prescription and FDA-approved products, is enforced by the county Department of Health, and becomes void if a state law covering the same ground takes effect. This matters directly to us because Hudson Valley Botanicals operates from Dutchess County: we sell leaf only and carry no 7-OH or concentrated extracts, so nothing on our shelves is reached and orders to Dutchess addresses continue normally. The relocation contingency we described before the vote is no longer in play. Statewide 21+ age and warning label rules remain in effect across New York. The law does not state an effective date, so it takes effect once it is filed with the Secretary of State.
