Philadelphia Mayor Cherelle Parker signed Bill No. 260163 on September 15, 2026, after City Council passed it 16-0 on June 4. It adds Chapter 9-6700 to the Philadelphia Code and classifies kratom products and intoxicating hemp products as intoxicating substances. From November 12, 2026 it is unlawful for any person to sell or offer for sale an intoxicating substance in the city unless it is FDA-approved, which in practice covers all kratom, or to sell one to anyone under 21. Each day of a violation counts as a separate Class III offense. City retailer permits, with testing and labeling rules, take effect only once the city issues regulations.

The ordinance does not mention deliveries or online sellers. Hudson Valley Botanicals will stop shipping to Philadelphia addresses before the ban takes effect on November 12.
