Update, October 16, 2026: the City of Bellingham confirms the ordinance took effect October 13, 2026. It amends Chapter 10.08 of the Bellingham Municipal Code to prohibit the preparation, distribution and sale of kratom products in city limits. The City Council adopted it on its third and final reading on September 28, 2026, 6 to 0 with one member absent. Hudson Valley Botanicals stopped shipping to Bellingham, Washington addresses on October 5, 2026.

Violations are a gross misdemeanor carrying up to one year in jail or fines up to $5,000, which is sharper than the civil penalties in the Mount Vernon ordinance the text is modelled on. Possession and purchase are not prohibited.

Distribution is the operative term for a mail order seller, which is why we stopped shipping there.
