It makes sales to anyone under 21 unlawful, requires kratom at retail premises to be kept behind the checkout counter or in a locked cabinet, bars kratom sales within 500 feet of any building used for school purposes, and requires kratom businesses to comply with General Business Law section 398-g and Public Health Law sections 1399-xx and 1399-mmm. Penalties are $500 for a first violation and $1,000 for a repeat within 18 months, with each sale to a minor and each day of improper display counted separately. The Oswego County Health Department and/or Board of Health enforce it and may send a warning letter instead. It applies to kratom sales and displays at retail, has no clause aimed at sellers shipping into the county, and becomes void once the State enacts the same or substantially similar provisions. It takes effect on the 90th day after adoption, December 9, 2026.
The same night the Legislature adopted Resolution No. 227 (Agenda Item HE-3), also 21 to 0 with 4 absent, urging New York to add kratom and its derivatives to the state controlled substances schedules and citing A04034/S07379. Copies went to State Senators Chris Ryan and Mark Walczyk and Assemblyman William Barclay.
