The following terms and conditions shall apply to the sale of products by Hudson Valley Botanicals LLC ("The Seller") to the purchaser of Products ("The Buyer"). By using our website www.hudsonvalleybotanicals.com and all of the products and services offered by The Seller, you agree with these terms & conditions.

The Seller reserves the right to alter these terms & conditions without prior notice. The Buyer agrees to all of the terms and conditions applied to them by The Seller by the disclaimer agreement displayed within these Terms and Conditions.

Eligibility

As a purchaser of products from this website, The Buyer confirms that they meet the minimum age requirements for their state and are legally able to purchase the products offered. The Buyer acknowledges that our products are intended for purchase and use only by adults of legal age.

All other states where kratom is legal

State and local laws regarding kratom are subject to change. It is The Buyer's responsibility to verify the current legal status and age requirements in their jurisdiction before placing an order. Hudson Valley Botanicals does not ship to states, counties, or municipalities where kratom is prohibited.

By placing an order, you represent and warrant that you are of legal age in your state and have the legal capacity to enter into this agreement.

Product Information

The Buyer recognizes that the products offered by The Seller have not been approved for use by the Food and Drug Administration, and as such are not intended to diagnose, treat, cure, or prevent any disease.

Our products are not dietary supplement(s), but a precise amount of a pure ingredient, sold as a raw material. We attest exclusively to the quality, purity, and description of the ingredients we provide. Our products are for use and handling only by persons with the knowledge and equipment to safely handle these ingredients.

The Buyer agrees to keep our products out of the reach of children. Our products have limited research available about them and improper usage may result in adverse effects if improperly handled or consumed.

Shipping

🚨 All orders ship via US Postal Service (USPS) or UPS. The Buyer understands that once an order has shipped, loss or damage that occurs during shipment is The Buyer's responsibility.

🚨 The Seller is not liable for any damage, theft, mistakes by the carrier, or any other circumstances that The Seller has no control over.

USPS Shipping Times

USPS Priority Mail typically takes 2 to 3 business days to arrive
USPS Priority Mail Express typically takes 1 to 2 business days to arrive

UPS Shipping Times

UPS Ground Advantage typically takes 2 to 5 business days to arrive (depending on distance)
UPS Ground typically takes 1 to 5 business days to arrive (depending on distance)
UPS 3 Day Select typically takes 3 business days to arrive
UPS 2nd Day Air typically takes 2 business days to arrive
UPS Next Day Air typically takes 1 business day to arrive

General Shipping Terms

The length of time for a package to transit from The Seller's origin to The Buyer's destination is in no way guaranteed
Same day shipment is not guaranteed by The Seller
Delivery times are estimates provided by the carriers and may vary based on location, weather, and other factors beyond our control

The Seller cannot be held responsible for late or lost packages due to the shipping carrier (USPS or UPS). All Express packages that do not arrive within the carrier's guaranteed timeframe will receive a shipping refund upon request, subject to carrier confirmation of the delay.

There are instances where a shipment has failed to reach its destination, and reasons for this include incorrect address, refusal of shipment, or nonpayment. In the case a shipment gets returned to us due to The Buyer's fault, we will refund the amount, minus the shipping cost (even if The Buyer was eligible for free shipping).

Customer Satisfaction Guarantee

At Hudson Valley Botanicals, we stand behind the quality of our products. If you are not completely satisfied with your unopened purchase, you can request a store credit within 30 days of receiving your order by following these steps:

The product must be in its original, sealed, unopened packaging
Contact our customer service team through our website's contact form with:
- Your order number
- Product name
- Reason for return
- Photos showing the sealed/unopened product and packaging

Important Terms:

Return requests must be submitted within 30 days of delivery
A store credit equal to the purchase price of the returned product will be issued after we receive and inspect the unopened product
Credit can be used toward future purchases within 12 months
Return shipping costs must be paid by the customer
Products must have been purchased directly from our website
For safety and quality assurance, we cannot accept returns of opened or used products
Items damaged during return shipping will not be eligible for credit - please package your return carefully
We are not responsible for items damaged or lost during return transit
We reserve the right to deny return requests that do not meet these criteria
There is also a $1.50 refund charge if you used a credit card

Payment

We accept various payment methods as indicated on our checkout page. All prices are listed in US dollars. Payment must be received in full before orders are processed and shipped.

The Seller reserves the right to change prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available in the shopping cart when you place an order.

Liability

In no event shall The Seller be liable for any use by The Buyer of the Products or any loss, claim, injury, damage or liability, of whatsoever kind of nature, which may arise from or in connection with this Agreement or the use, handling or storage of the Products.

The Buyer agrees to indemnify, defend, and hold harmless The Seller, its officers, agents, and employees from any liability, loss or damage they may suffer as a result of claims, demands, costs or judgment against them arising out of the use or disposition of the Products by The Buyer, except to the extent resulting from the gross negligence or willful misconduct of The Seller.

The Seller's maximum liability arising out of or in connection with any order, whether in contract, tort, or otherwise, shall be limited to the purchase amount paid by The Buyer for the product in question.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of law. Any dispute arising under or relating to these Terms and Conditions shall be resolved exclusively in the state or federal courts located in New York.

Changes to Terms

We may update our Terms and Conditions from time to time. We will notify you of any changes by posting the new Terms and Conditions on this page and updating the "Last Updated" date at the top of these Terms and Conditions. You are advised to review these Terms and Conditions periodically for any changes.
